  1. 1. INTRODUCTION

Please read these terms and conditions, its appendices, together with the Rules (together shall constitute, these “Terms”), carefully before using and/or accessing our Website (as defined below). By registering and/or using the Website you agree to be bound by these Terms and by the Privacy Policy. If you do not accept these Terms, you should not access and/or use the Website and/or the Services (as defined below).

In addition to these Terms, you should also read our Privacy Policy carefully, which sets out how we collect and use your personal information.

These Terms apply to your use of the Services, whether accessed via the Website or such downloadable mobile applications.

The most up-to-date Terms and Privacy Policy will be available on the Website and may be changed from time to time. We may need to change these Terms and the Privacy Policy from time to time for a number of reasons (including in order to comply with applicable laws, regulations, and regulatory requirements). Any minor or insubstantial changes may be made at any time and you are advised to review these Terms and the Privacy Policy on a regular basis. Please note that all major changes will be notified to you in advance of such changes taking effect. If any change is unacceptable to you, you should cease using the Website and the Services. If, however, you continue to use the Website and/or the Services after the date on which the changes to these Terms and/or Privacy Policy come into effect, you will be deemed to have accepted those changes. Note that these Terms and the Privacy Policy relate to the Services only. Separate terms and conditions apply for players based in the United Kingdom using our lottery syndicate services for UK national lotteries (“Syndicate Services”) and are available on the relevant webpages which can be found here.

If these Terms and/or Privacy Policy are published in any language other than English, where there is a discrepancy, the English language version will prevail.

  1. 2. WHAT ARE THE SERVICES AND WHO AM I CONTRACTING WITH?

2.1 What are the Services?

The Website enables players to:

  • • place Bets on the outcome of lotteries through the Website and/or our Telebet Service (the provision of which is collectively referred to as the “Gambling Services”). Please note that when you use the Gambling Services, you are therefore not participating in a lottery, and instead placing a Bet on the outcome of a lottery. When you place such a Bet you are entering into a contract with us, not with the lottery provider;
  • • place bets on the outcome of our own lottery-style draws using our certified random number generator “iRNG”; and
  • • where applicable, play Games.

2.2 Who am I contracting with?

By accessing the Website or using the Services you are contracting with Lottomatrix Operations (as defined below). Lottomatrix Operations provides the Services to Players through various licences, dependent on where such Players are based:

  • • If you are based in the United Kingdom ("UK"), the Services are provided to you under a UK Gambling Commission's licence, reference number: 049262.
  • • If you are based in the Republic of Ireland, the Services are provided to you under a Remote Bookmaker's licence number 1012916.
  • • If you are based in Sweden, the Services are provided to you under a Swedish Gambling Authority (Spelinspektionen) license, issued in case number 18Li7534, valid through 21 January 2024.
  • • If you are based in any other country, the Services are provided to you under a Malta Gaming Authority's licence (“MGA”) MGA/B2C/362/2016 issued on 1 August 2018.

Please note that:

  • • If you registered an account on the Website prior to 23 October 2017 and you reside in the UK, you have contracted with Lottomatrix Limited, a company incorporated under the laws of England and Wales, whose company number is 10028806, with registered offices at Princes Exchange, Princes Square, Leeds, LS1 4HY, (“Lottomatrix Limited”) and the account you created has been transferred to Lottomatrix Operations.
  1. 3. DEFINITIONS

For the purposes of these Terms, the following terms will have the following meanings:

"Bet" - a bet on the outcome of a certain real event, for example the result of a certain lottery, including iRNG, as offered on the Website and submitted via the Website.

"Games" - are Casino, Live Casino, Poker, Scratch cards, Instant Win Games and any other game on the Website (including mobile or any other platform) and “Game” can mean any one of them. We can remove or add Games to the Website at any time.

"Instant Win Games" -virtual, random number generator-based games available on the Website.

"iRNG" - a random number generator used by us to conduct lottery-style draws. The random number generator is compliant with the applicable regulatory model and standards.

"Jackpot" - in the case of a Bet, the maximum possible Winnings in respect to the relevant Prize Group of the relevant Source Lottery (without the DoubleJackpot option). Jackpots can be fixed to an amount chosen and advertised by us.

"Lottomatrix Operations Limited" – a company incorporated in Malta, whose company number is C 80365, with registered offices at Vincenti Buildings 28/19 (Suite no.1969), Strait street, Valletta, VLT 1432, Malta.

"Player(s)" - a registered user of the Website (also referred to as “you” or “your”).

"Purpose" - the purpose of participating in the Services and/or the Syndicate.

"Services" - the services provided by us to Players via the Website and/or via the telephone as further detailed in clause 2 above.

"Source Lottery" - a lottery, on which a Bet is placed by a Player.

"Successful Bet or Successful Entry" - is a winning Bet which is placed on the outcome of a Source Lottery via the Website and/or over the telephone through our Telebet Service, in accordance with these Terms.

"Stake(s)" - refers to the amounts a Player decides to stake in respect of a certain Instant Win Game.

"Syndicate(s)" – are the services described in Appendix 1 below, in which you can Bet on a number of entries of a lottery or lotteries by purchasing shares. You will receive a share of the winnings if any of the entry wins at any Prize Group level including a Jackpot.

"Rules" - separate sets of rules which apply to the different products made available on the Website from time to time, which can be found under the Help tab of the applicable section of the Website.

"Website" - the domain www.jackpot.com and any subdomains or related domains you may be redirected to (depending on your location), including but not limited to uk.jackpot.com, se.jackpot.com and www.jackpot.ie, and if you are using the Services via a downloadable mobile application, all references to the “Website” shall refer to that mobile application.

"Winnings" - the return paid to a Player in respect of a Successful Bet or the prize money won by a Player in playing an Instant Win Game. All references to “we”, “us” and “our” in these Terms shall be read as referring to Lottomatrix Operations and/or Lottomatrix Limited, as appropriate.

A. THE SERVICES

  1. 1. Who May Use the Services

1.1. You must not access or use the Website and/or the Services (or attempt to do so) unless: (i) you are 18 years old or older; or (ii) if you are based in a jurisdiction in which you must be older than 18 in order to gamble, place Bets and/or Stakes (for example in Estonia, where you must be 21 years old), you are of the legal age to gamble, place Bets and/or Stakes in such jurisdiction ("Legally of Age").

1.2. Access or use of the Website and/or the Services may be illegal in certain countries, irrespective of your age. You are responsible for determining whether your accessing and/or use of the Website and/or the Services is compliant with applicable laws in your jurisdiction and you confirm to us that your use of the Website and/or the Services is not illegal in the territory from which you access them.

1.3. The use of the Website and/or the Services is illegal for any person, citizen of, or a person who is: (i) residing in a country listed in the latest statements by the Financial Action Task Force as posing a risk to the international financial system published here; (ii) listed on the financial sanctions list of Her Majesty's Revenue and Customs (“HMRC”) found here.

1.4. In addition to the foregoing, there are certain territories which we actively block access from, a list thereof can be found here. Please note that our list of blocked territories does not necessarily correlate to those jurisdictions where we have taken a view on legality, equally if a territory is not blocked, that does not amount to a representation on our part that use and/or access of the Website and/or Services from such territory is legal. Please note that we may update the foregoing from time to time (for example due to changes in applicable law).

1.5. You must not access and/or use the Website and/or the Services (or attempt to do so) if you are based in any of the jurisdictions referenced in clauses 1.3 through 1.4 above or any jurisdiction in which it is illegal to do so (referred to collectively as, “Prohibited Jurisdiction(s)”).

1.6. When you are based in the UK, you cannot place a Bet:

(i) on a EuroMillions draw; or

(ii) on the outcome of a EuroMillions lottery, regardless of the name given to that lottery or how that lottery is described in any jurisdiction, irrespective of your country of registration or where you may normally be based. For subscriptions (as referred to in clause 10.12 below) if you choose and place your Bet on EuroMillions whilst in the UK, we will not accept it. There is nothing to preclude you from advance playing in future weeks, provided you place your Bet and we accept it in accordance with clause 17 below, when you are not in the UK.

1.7 If you are based in Sweden, please note that, due to legislative or regulator restrictions, certain products described in these Terms may not be available to you.

  1. 2. Provision of the Services

2.1. We are committed to providing excellent customer service and as part of such commitment, we are committed to supporting responsible gambling. Although we will use our reasonable endeavours to enforce responsible gambling policies, we do not accept any responsibility or liability if, for reasons outside our reasonable control, you continue to gamble and/or place Bets or Stakes and/or seek to use the Website and/or the Services with the intention of deliberately avoiding the relevant measures and protections in place.

2.2. We may suspend, modify, remove or add to the Services, from time to time, with immediate effect and without notice to you. If we make such a change that affects a Bet that you have already placed but has not yet settled (for example by removing a lottery from the list of lotteries available to Bet on), your Bet will be voided, and we will return the applicable staked amounts back to you. Save for where we have not used reasonable care and skill, we shall not be liable for any loss suffered as a result of any such changes and you shall have no claims against us in this regard.

2.3. We only permit and accept use of the Services online (including via mobile device or downloadable applications on a mobile device) and/or through our Telebet Service.

B. YOUR JACKPOT.COM ACCOUNT

  1. 3. Application

3.1. To register for an account on the Website and/or use the Services, you must:

3.1.1. be Legally of Age;

3.1.2. reside in a territory that is not a Prohibited Jurisdiction;

3.1.3. have a valid bank account or credit or debit card or alternative payment method, that is approved by us and that is registered to an address in a territory that is not a Prohibited Jurisdiction;

3.1.4. fully and accurately complete the required information while registering to the Services; and

3.1.5. fully comply with these Terms in relation to your use of the Website and/or the Services.

3.2. You may open only one account. You must never access the Services by means of another person's account. Should we identify that you operate and/or use more than one account, we may treat any such accounts as one joint account.

3.3. You shall not use your account or the Services for any professional, business or commercial purpose, nor will you allow another person to use and/or access your account.

3.4. You are not allowed to transfer funds from your account to any other Player or receive funds from others into your account. Furthermore, you may not sell, transfer and/or acquire Website accounts to and/or from other Players.

3.5. We reserve the right to and may refuse any account registration request.

  1. 4. Age and Identity Verification

4.1. Following your application for an account, we may ask you to provide us with proof of age, as part of our age-verification checks. If you are a resident of either the UK or Sweden, you will not be able to gamble (with your own money, a free bet or a bonus), place Bets or Stakes, deposit, access free-to-play games and/or withdraw any amount deposited into your account, until we have completed our age-verification checks. If age verification has not been satisfactorily completed, we may: (i) suspend your account; (ii) restrict your access to the Website and/or the Services until age verification has been successfully completed; and (iii) if on completion of age verification you are shown not to be Legally of Age, return all deposits to you (note: any Winnings obtained during this time shall be deemed invalid and shall not be paid out to you).

4.2. By accepting these Terms and/or registering to use the Website and/or the Services you hereby agree that we shall be entitled from time to time to conduct such identification, credit and other verification checks (including, but not limited to, verifying your source of funds) that we may choose to do and/or are required to do according to applicable laws, regulations and/or regulatory authorities. If you are based in the UK, you will not be able to place a Bet or Stakes before we are able to confirm your identity. You agree to provide all such information as we require in connection with the foregoing verification checks. Until such time as the relevant checks are completed to our satisfaction, we may suspend or restrict your account.

4.3. All information supplied when registering with the Website and/or Services must be accurate, true and complete in all respects. In particular, when using a credit or debit card, the cardholder's name must be the same as the name used when registering with the Website and/or Services, unless you provide valid and verifiable reasons for it being different. Where the identification provided is inaccurate or incomplete, suspension of the account will occur until identity verification has been satisfactorily completed. Where an account is suspended, the relevant customer should Contact Us.

4.4. We may elect to confirm your address by posting an address verification letter to you and/or by asking you to provide us with a certified or notarized copy of your bank statement or utility bill. All the foregoing correspondence will be discreet, and the envelope sent to you will not display any reference to any branding. Please note that we may suspend your account until such address verification is completed satisfactorily.

4.5. As part of registration, purchase, pay out of winnings and/or ongoing monitoring of your account, we may ask you to provide us with certain documents required for our “Know Your Customer” process (“KYC Documents”), such as copies of your Passport/Identity Card, proof of payment details, evidence of source of income and/or source of wealth, Bank Statement, Utility Bill, etc and may ask you to provide updated KYC Documents in case such expire. We may ask you to provide us with certified/notarized copies of your KYC Documents in case these are required in order for us to be able to comply with statutory and/or regulatory requirements, including but not limited to Anti Money Laundering requirements. It should be noted that Players have thirty (30) days in order to send us their KYC Documents, once a request for such has been made, and no withdrawals will be permitted until all KYC Documents have been received. If a Player fails to comply with our requirement to provide KYC Documents during a consecutive period of thirty (30) days, we may terminate the relationship with such Player.

4.6 As part of registration and the ongoing monitoring of your account, we may supply your information details to authorised credit reference agencies, to confirm your identity and payment card details. You agree that we may process such information in connection with your registration.

  1. 5. Player’s Account

5.1. You must keep your password and all account details secret and confidential as you are solely responsible for use of the Website and/or Services from your account and any other activities taking place through your account. Any transactions on your account will stand if your username and password have been entered correctly.

5.2. If, at any time, you feel that a third party is aware of your user name and/or password, you should change it immediately via the Website. Should you forget part or all of your username and/or password combination, please Contact Us.

5.3. You must keep your account details accurate and up to date. These details may be amended in the Account Details section of the Website. If you require any assistance in accessing such details, please Contact Us.

5.4 Players can lock their Player Account at any time (“Temporary Suspension” or “Self-Exclusion”). In order to affect a Temporary Suspension or Self-Exclusion Players may use the respective facility in ‘My Account’ section on the Website, while Players may determine the duration of their Temporary Suspension or Self-Exclusion.

  1. 6. Personal Information

6.1. We take our obligations under data protection laws, which apply to us, very seriously. Please read our Privacy Policy for more information about how your personal information is used by us.

6.2. We will comply with applicable data protection laws, including (i) the General Data Protection Regulations, (ii) for accounts in the UK and the Republic of Ireland, the Data Protection Act 1998, (iii) for accounts in Sweden, Law (2018: 218) with supplementary provisions to the EU data protection regulation (lag (2018:218) med kompletterande bestämmelser till EU:s dataskyddsförordning), and (iv) for any other accounts, the Protection Act, Chapter 440 of the Laws of Malta), in respect of the personal information you provide to us.

  1. 7. Closing your account

7.1. If you want to close your account, please Contact Us. Any negative balance on your account will fall immediately due and payable to us, and your account will not be closed until the relevant amount owed to us is paid in full. Please note that if you want to close your account because you believe you have problems controlling your gambling, you should refer to our Responsible Gambling resources set out here.

  1. 8. Breach of Terms, Collusion, Cheating Fraud, Criminal Activity and Account Closure / Suspension

8.1. We, at our sole discretion, may close or suspend your account at any time and for any reason. If we do so, we will void all outstanding Bets and/or Stakes and return all associated staked amounts and remainder amounts in your account to you.

Irrespective of the foregoing, if any of the following instances occurs, we have the right to withhold the whole or part of your balance and/or recover from the account the amount of any deposits, pay outs, bonuses or winnings which have been affected by or are in any way attributable to any of the events listed in clause 8.2 below.

8.2. We may suspend or close your account, and shall have those additional remedies set out in clause 8.3 below, under the following circumstances:

8.2.1. you become bankrupt;

8.2.2. we reasonably believe that you have used an account in another individual's name or for another individual's benefit, or acted in concert with other individuals;

8.2.3. if we reasonably believe that you have breached in whole or in part any provision contained in these Terms;

8.2.4. we reasonably believe that you have used the Website and/or the Services in a fraudulent manner or for illegal and/or unlawful purposes, including, but not limited to, any criminal activity;

8.2.5. we reasonably believe that you have acted for any purpose other than the Purpose, including any professional, business or commercial purposes;

8.2.6. we reasonably believe that you have used the Website and/or the Services in an unfair manner, have deliberately cheated or taken unfair advantage of us or any of our customers (for example by using software to manipulate the time of Bet placement, find out details of other Players' Bets and/or Stakes, or place a Bet or Stake under an identity other than your own);

8.2.7. we reasonably believe that actions from your account, in relation to your use of the Website and/or the Services, were executed using artificial intelligence;

8.2.8. we are requested to do so by any law enforcement agency, any regulatory authority or court order;

8.2.9. we reasonably believe that any of the events referred to in this clause 8.2 may have occurred or are likely to occur;

8.2.10. we reasonably believe that you have attempted to access the Services from a Prohibited Jurisdiction;

8.2.11. we reasonably believe that you have abused bonuses or other promotions; or

8.2.12. we reasonably believe that you have used unfair external factors or influences (known as cheating).

The rights set out in this clause do not affect any other rights (including any common law rights) we may have against you, under these Terms or otherwise.

8.3. We may void your Bets and/or Stakes on Source Lotteries and/or Games, respectively (including, for the avoidance of doubt, even after a relevant draw has taken place, which would have entitled you to certain Winnings, except for a breach of the below sub-clauses), if, at any time, you are found to:

8.3.1. not be Legally of Age;

8.3.2. reside in a Prohibited Jurisdiction;

8.3.3. be a citizen of or residing in a country (as referred to in clause 1.3 above) listed in the latest statements by the Financial Action Task Force as posing a risk to the international financial system, and/or any person listed on the financial sanctions list of HMRC;

8.3.4. not have a valid bank account or credit or debit card or alternative payment method that is approved by us and that is registered to an address in a territory that is not a Prohibited Jurisdiction; and/or

8.3.5. have materially breached these Terms.

8.4. If you are based in Sweden, following the closing of your account, we will pay out your remaining balance to you within five (5) bank days. However, if your account is closed due to your exclusion from gambling as a result of misconduct, we will only pay back that which remains of the deposits made by you. If we close your account, you will be informed in writing thereof and the reasons for the decision.

  1. 9. Inactive and Dormant Accounts

9.1. An account is deemed to be ‘inactive’ during any period in which a player’s account has not recorded any log in and/or log out for a period exceeding 12 consecutive months.

9.2. If your account is ‘inactive’ for a period of 365 consecutive days, the following shall apply:

9.2.1. If the balance on your account is zero (0), we may close your account and no fee shall apply.

9.2.2. If, on being deemed to be inactive, your account has a positive balance, we shall take reasonable steps to notify you, using the details you provided during your registration process (or as updated by you).

9.2.3. If your account is not regulated by the UK Gambling Commission and it remains inactive after a period of 12 (twelve) consecutive months, we may deduct a monthly administration fee from your account balance equal to €5 (EUR) or 50 SEK per each month, after providing you with at least 30 (thirty) days prior notification and providing you with the option to withdraw the deposited funds in order not to incur such fees (for Players registered under our Maltese licence, this is in accordance with the Malta Gaming Authority ‘Inactive Accounts Directive 2011’ and the ‘Gaming Authorisations and Compliance Directive’ of 2018).

9.3. You can “reactivate” your account by logging in and/or out from your account.

9.4. For Players outside the UK (i.e. not regulated by the UK Gambling Commission), Sweden and the Republic of Ireland:

9.4.1. If you do not access your account (with a real money balance) for 30 consecutive months, i.e. your account becomes dormant and if we have been unable to contact you and/or if you cannot be satisfactory located, in accordance with applicable law, we shall close your account and transfer your remaining account balance to you or, for players registered under our Maltese licence, to the MGA.

9.4.2. Account holders who wish to recover funds held in a closed or excluded account, are advised to contact Customer Support.

9.5. For the avoidance of doubt, the arrangement outlined in clause 9.2.3 above shall not apply to an account regulated by the UK Gambling Commission. In the event that your UK Gambling Commission regulated account is inactive for a consecutive 12 (twelve) month period, we may deduct periodic fees or charges, until (i) the account is closed, (ii) the account becomes active again, (iii) or in case the account balance is exhausted, provided however that:

9.5.1. we made reasonable efforts to repay to you your remaining account’s balance to the last payment method you used while using the Services (subject always to compliance with applicable law);

9.5.2. the fees or charges that will be applied shall not exceed £5 (GBP) per month; and

9.5.3. all reasonable steps have been taken to remind you, no less than 30 days beforehand, of the terms that apply to you and that the fees or charges will be imposed by a specified date if your account still remains inactive by the specified date.

9.6. In case that an account regulated by the UK Gambling Commission remains inactive, and in addition to the provisions of clause 9.5, in the event of our inability to contact you via the contact details which you provided to us, we may donate the funds to a charity concerned with the research and/or educational treatment of gambling related harm.

C. YOUR FINANCES

  1. 10. Deposits

10.1. Please note that we do not offer any credit facility and you may Bet or Stake only by utilizing the amount of cleared funds held in your account. Accordingly, if you want to place a Bet on a Source Lottery or place a Stake on any Game, you must deposit funds into your account. You may only deposit funds to your account for the Purpose. Please see https://www.jackpot.com/banking for information on all deposit options.

10.2. We may void any attempted Bets or Stakes which may have inadvertently been accepted by us when the account did not have sufficient funds to cover the Bet or Stake.

10.3. You hereby authorise us to deduct monies to pay for the Services as requested by you from time to time as well as any applicable administration charges and fees which have been brought to your attention under these Terms.

10.4. We may impose different minimum and maximum amounts for deposits, Bets or Stakes during a particular time period. We will notify you in the instance that we impose any such limits.

10.5. We may use additional procedures and means to verify your identity and conduct "Know Your Customer" ("KYC") procedures when effecting deposits into your account.

10.6. You should only deposit funds into your account from a source where you are the named account holder or by a payment method which is secured by a pin code, password or another identity verification process. You may change your payment method, provided we are satisfied that the applicable verification checks set out in clause 4 above are met. In cases where we identify that your chosen payment method does not meet the foregoing requirements, we may treat any deposits into your account as being invalid and any Bets and/or Stakes made with such deposit as being void. Upon your request, we will return all such deposited amounts to the source from which they were received by us.

10.7. It is prohibited and unlawful to deposit money from ill-gotten means. Therefore, all transactions are checked to prevent money laundering and all suspicious transactions will be reported to the Gaming Operator’s Money Laundering Reporting Officer (MLRO) who will report to and advise the relevant authorities.

10.8. Depending on the payment method selected, deposits can incur charges or processing fees from third parties. Your bank may independently charge you for bank wire transfers and other methods of payment.

10.9. You agree that we shall be entitled to retain any interest which might accrue on funds held in your account.

10.10. It is your responsibility to inform us without delay should any funds be credited to your account in error. We shall recover such funds by account adjustment.

10.11. We may, at any time, set-off any positive balances in your account against any amount owed by you to us.

10.12. Where applicable, you can choose the subscription option to place automated Bets for products on the Website, with pre-set intervals. Any cancellation request should be delivered to us in writing at least 72 hours prior to the end of the respective subscription period (considering the subscription period for which you have registered). Any such request will be considered “delivered” only once an acknowledgement of receipt is sent to you by us. We may change our subscription plans and their respective pricing from time to time, however, any price changes or changes to our subscription plans will apply to you no earlier than 30 (thirty) days following notice to you.

  1. 11. Winnings and Withdrawals

11.1. All Winnings in respect of Successful Bets shall be paid out in accordance with Appendix 1 to these Terms. As set out in Appendix 1, provided we have used reasonable endeavours to obtain the relevant funds, you acknowledge and agree that we will only be liable to you for any Winnings in respect of Successful Bets to the extent that we have received the funds from the applicable third party. We will pay your Winnings to you to the extent that, and as soon as, we receive the corresponding funds from the applicable third party. As a result, there may be instances where your receipt of Winnings in respect of Successful Bets may be delayed and/or we may be unable to pay out in accordance with the table set out in Appendix 1. All Winnings in respect of Games will be paid out in accordance with the Rules that apply to the applicable Instant Win Game. 11.2. If your account is regulated by the UK Gambling Commission, you have the unrestricted and legal right to withdraw your full cash balance (this will also include any winnings realised from Bets and/or Stakes using your own funds) at any time in a single transaction. However, certain withdrawal requests may be subject to you completing and satisfying additional due diligence, account activity checks and verification checks as referenced in clause 11.9 below. 11.3. All withdrawals will be processed to the account from which the deposits were made. Withdrawal payments can only be made in the name of and to the registered account holder. All our withdrawal methods can be found here.

11.4. To request a withdrawal, you should click the ‘Withdraw’ button on the Website. Subject to clause 11.5 below, there being sufficient funds in your account to withdraw and your withdrawal request meeting the minimum withdrawal limit, the withdrawal will then be processed. In exceptional circumstances or for certain payment methods, we may require additional documents from you before we are able to process the withdrawal. We will notify you if we require such information shortly after your withdrawal request is made.

11.5. The applicable minimum withdrawal limits can be found here. Please note that these limitations will not apply if you are either closing your account or withdrawing all the balance on your account. For the avoidance of doubt, withdrawal limits shall not apply to accounts which are regulated by the UK Gambling Commission.

11.6. If you make a deposit and have not fully Staked or Bet an amount equal to the value of the deposited amount before you request a withdrawal, we may apply a charge of 5% of the amount requested to be withdrawn (up to a maximum of €5 (EUR) or £5 (GBP), depending on the currency of your account). The foregoing charge will be applied to the balance of your account or the value of the withdrawal requested to cover all reasonable costs incurred by us relating to both the deposit and the withdrawal. We may withhold any withdrawal requests for due diligence purposes, until we receive sufficient explanation from you as to why the deposit amount was not played in full. If you are based in Sweden, the foregoing charge described in this clause will not apply to you.

11.7. The method by which we transfer withdrawn amounts out of your account may vary depending on the size of the transaction. Any third-party bank and payment processing charges and fees incurred are borne by you and we are entitled to debit your account accordingly.

11.8. Withdrawals processing on our system will take up to five (5) business days.

11.9. We actively combat money-laundering. All transactions are checked to prevent money-laundering and suspicious transactions are reported to the relevant authorities. Pay outs from a Player’s account to the Player will be made to the bank account or credit card from which the funds deposited into the Player’s account originated. Transactions will be made in accordance with the choice of withdrawal method provided by the Player to us. Any free Bets, Stakes, bonuses or Winnings credited to your account in error are not available for use by you, and we may void any transactions made by you of such funds and/or withdraw the relevant amount from your account and/or reverse the transaction, either at the time, or retrospectively, when we become aware of the error.

11.12. We reserve the right to withhold payment and to declare Bets and/or Stakes on an event void if we have evidence that the following has occurred:

(i) the integrity of the event has been called into question;

(ii) the price(s) or pool fund has been manipulated;

(iii) matchrigging has taken place;

(iv) you were not Legally of Age when you placed the Bet or Stake;

(vii) you placed the Bet or Stake while you are aware of any circumstances which would make the placing of the Bet or Stake breach a rule on betting applied by a sport governing body;

(viii) you are prohibited from doing so under these Terms, including but not limited to the provisions of clause 23.3 below or otherwise; or

(ix) we have not been able to verify your identity and address and, in particular, have not been provided with a copy of government issued photo ID for the purpose of verifying your age.

11.13. At any point of the withdrawal process or at any potentially suspicious activity, you may be requested to provide us with additional documentation proving your identity and/or address to our satisfaction, while failing to do so will entitle us to suspend or close your account immediately.

11.14. Evidence of the above may be based on the size, volume or pattern of Bets or Stakes placed with us across any or all Services.

11.15. If you owe any money to us for any reason, we have the right to take that into account before making any payments to you or permitting you to withdraw any funds from your account.

  1. 12. Currencies and Exchange Rates

12.1. If you are based in the UK, deposits, Bets and Stakes will be in Pounds Sterling (GBP). If you are based anywhere other than the UK or Sweden, deposits, Bets and Stakes will be in Euros (EUR).

12.2 If you are based in Sweden, deposits, Bets and Stakes will be in Swedish Krona (SEK).

12.3. For any deposit, Bet, Stake or pay out of Winnings involving an exchange in currency, the applicable rate of exchange will be the same exchange rate that is imposed on us by our bank at the time of the relevant deposit, Bet, Stake, pay out of Winnings or otherwise.

12.4. We may pay Winnings in either the currency used to deposit into the applicable account, Euros (EUR) or the currency used by the Source Lottery.

  1. 13. Chargebacks, Reversals, Taxes, Withholdings and Miscellaneous

13.1. If we incur any chargebacks, reversals or other charges in respect of your account, we may charge you for the relevant amounts incurred.

13.2. In the event that any Winnings incur taxes, duties or levies, these are borne by you.     1. 22. Your Covenants to Us

    22.1. You confirm the following to us:

    22.1.1. You are not based in a Prohibited Jurisdiction;

    22.1.3. All details provided by you to us either during the registration process or at any time thereafter, including as part of any payment deposit transaction, are true, current, correct and complete and match the name(s) on the credit or debit card(s) or other payment accounts to be used to deposit or receive funds in your account, unless we have been able to verify the reason for the difference to our satisfaction;

    22.1.4. You have verified and determined that your use of the Services does not violate any laws or regulations of the jurisdiction that applies to you;

    22.1.5. You will not commit any acts or display any conduct that damages our reputation;

    22.1.6. You are solely responsible for recording, paying and accounting to any relevant governmental, taxation or other authority for any tax or other levy that may be payable on any Winnings;

    22.1.7. You acknowledge and agree that we may publish the amounts you have won alongside the first letter of your name and the first letter of your surname (your initials) on the Website and/or through social networks. If you win an amount equivalent to €50,000 (EUR) or more, you may be invited (but are not obliged to attend) to receive such Winnings at a hospitality and handover ceremony organised by us (that might be open to the media, subject to our discretion) and to give an interview or interviews subject to full prior disclosure as to what the ceremony will involve (this does not apply to Players that are resident in the UK).     1. 23. Third Party Content

    23.1. We receive content from a number of suppliers. Certain third-party product providers may require you to agree to additional terms and conditions governing the use of their content.     23.2. We do not accept any liability in respect of any third-party content.

    23.3. We do not allow any of our employees, their immediate families, officers, directors, or third parties that relate to our group of companies (“Group”) or provide services to the Group to Bet or Stake on any event. We will void any Bet or Stake where such has taken place during the term, and for a period of three (3) months thereafter, in which the respective employees, their immediate families, officers, directors, or third parties which relate to the Group or provide services to the Group are employed by or provide services to us.

    23.4. Where the Website and/or the Services contain links to third-party websites and resources, these links are provided for your information only. We have no control over the content of these sites or resources and accept no liability for them or for any loss or damage that may arise from your use of them. The inclusion of a link to a third-party website does not constitute an endorsement of that third party’s website, product or service.

    1. 24. Errors

    24.1. We do all that we can to avoid errors, but in some instances, errors may still occur. “Obvious errors” include, but are not limited to: (i) the publication of incorrect pricing, incorrect prizes and/or Jackpots or prize distribution of a Source Lottery or incorrect terms of a Bet or a Stake as a result of human error or due to computer malfunction; (ii) us erroneously accepted Bets or Stakes from you after the relevant deadline or after the start of the relevant draw; (iii) instances where the amount of Winnings paid to you has been miscalculated as a result of human error or due to computer malfunction; (iv) in accordance with the applicable Rules, a Bet or Stake which should not have been accepted in the first place.

    24.2. In case of the circumstances set out under clause 24.1 above, we may: (i) correct the error and resettle the Bet or Stake at the correct price or terms applicable to when the Bet or Stake was placed; or (ii) declare the Bet or Stake void and return the staked amount to you. In addition to the foregoing, where an error is that a Bet is accepted with respect to a draw of a Source Lottery that should no longer be available, we may move such Bet to the next draw of such Source Lottery.

    24.3. When we notice that a pricing error has occurred and where there is sufficient time to do so before the start of an event, we will endeavour to contact you and allow you to cancel the Bet.

    1. 25. Miscellaneous

    25.1. We actively monitor traffic to and from the Website. We may block access where evidence indicative of automated or robotic activity is found.

    25.2. We may restrict access to all or certain parts of the Website and/or Services in respect of certain jurisdictions.

    F. OUR LIABILITY TO YOU

    26. Subject to clauses 28 and 29 below, in no case shall our liability to you exceed:

    26.1. in respect of your Winnings, the amount of Winnings properly due to you (subject to the maximum amounts set out in Appendix 1 for Winnings in respect of Successful Bets); and

    26.2. in respect of any other liability, the amount you Bet and/or Staked in the preceding six (6) months, up to a maximum of €5,000 (EUR), £5,000 (GBP) or 50,000 SEK, depending on your account currency.

    27. Subject to clauses 28 and 29 below, we are not responsible for:

    27.1. loss of profits;

    27.2. loss of business;

    27.3. loss of revenue;

    27.4. loss of opportunity;

    27.5. loss of data;

    27.6. loss of goodwill or reputation; or

    27.7. indirect losses which are a side effect of the main loss or damage you incurred, and which are not reasonably foreseeable by you and us at the time of you accepting these Terms.

    28. Nothing in these Terms shall exclude or limit our liability for fraudulent misrepresentation, for death or personal injury resulting from our, or our employees’ or agents’, gross negligence or wilful misconduct.

    29. You are entitled to certain legal remedies if we breach any of your rights which may apply notwithstanding these Terms. Nothing in these Terms is intended to affect such legal rights or other rights to which you may also be entitled.

    30. We endeavour to ensure that the Website and the Services are available to Players as much as is reasonably possible, but we cannot and do not guarantee that:

    30.1. the Website and/or the Services, or any part thereof, will be available at any specific time or for any specific period;

    30.2. the Website's features, functionality or performance will meet the Player's requirements or those of third parties; or

You shall execute or cause to be executed all documents and do or cause to be done all further acts and things consistent with the provisions of these Terms that we may from time to time reasonably require in order to vest in and secure to us the full benefit of rights and benefits to be transferred or granted to us under these Terms and for the protection and enforcement of the same and otherwise to give full effect to these Terms.

    40. Nothing in these Terms shall create or be deemed to create a partnership, joint venture or principal-agent relationship between us and you and no party shall have authority to bind the other party in any way unless expressly provided otherwise in these Terms.

    41. We shall not be in breach of these Terms nor liable for delay in performing, or failure to perform, any of our obligations under these Terms if such delay or failure results from events, circumstances or causes beyond our reasonable control including, without limitation, any telecommunications network failures, power failures, failures in third-party computer hardware or software, fire, lightning, explosion, flood, severe weather, industrial disputes or lock-outs, terrorist activity and acts of government or other competent authorities. In such circumstances the time for performance will be extended by a period equivalent to the period during which performance of the relevant obligation has been delayed or failed to be performed.

    42. We may assign, transfer, charge, sub-license or deal in any other manner with these Terms, or sub-contract any of our rights and obligations under these Terms, to any party including any company within our Group, all in accordance with applicable law.

    43. Any notice to be given under these Terms must, subject to mandatory law, be in writing, in English and may be served by hand delivery, recorded delivery or registered post, airmail or email to: (i) in respect of notices given by you to us, our address as set out in clause 2.2 above or as displayed on the Website; and (ii) in respect of notices given by us to you, pursuant to the Player registration procedure (including any amendment to those details you have provided us).     45. A person who is not a party to these Terms has no right under any applicable law to enforce any of its terms.

You agree that you will not make or attempt to make any charge backs and/or deny or reverse any payment that you have made and you hereby agree that you will reimburse us fully for any charge backs, denial or reversal of payments you make and any loss (including bank penalty charges) suffered by us as a consequence thereof.

    K. GAMES AND INSTANT WIN GAMES

    63.1. A Player who wishes to make use of the Telebet Service may contact our Customer Experience team (“CE Team”), which may place a bet on behalf of the Player. CE Team may also contact Players in order to introduce and/or offer the use of the Telebet Service. It should be noted, that (i) only registered Players who previously opened an account on the Website will be able to utilize the Telebet Service; and (ii) in cases where the player is ‘Self-Excluded’, or on a ‘Time-Out’ option, use of the Telebet Service by such Player will not be allowed.

    63.2. When a Player contacts CE Team in order to place a bet, the Player will be required to provide CE Team with his/hers email address with which he registered to the Website in order for CE Team to be able to identify the Player. Any bet placed through the Telebet Service will be visible to the Player by accessing the ‘My Account’ section in the Website, where the Player can also find the betting ticket issued pursuant to the bet performed through the Telebet Service.

    63.3. All calls made by Players while placing a bet through the Telebet Service will be recorded as evidence of the placing of a bet.

    63.5. Depositing

    63.5.1. In order for a Player to place a bet through the Telebet Service, a Player must have the appropriate balance in his/her account. If a Player’s account balance is not sufficient in order to place the corresponding bet, CE Team will confirm with the Player whether he/she wish to deposit additional funds into his/her account. Deposits via Telebet Service will be accepted via Debit/Credit card only.

    63.5.2.     63.6. Player’s Account

    63.6.2. While using our Telebet Service, Players will also be able to set financial limits or self-exclusion periods through our CE Team.     63.7. Errors and Call Failure

    63.7.1. CE Team will make every effort to ensure that no errors are made while placing bets and/or depositing any funds to the Player’s account while using the Telebet Service. However, if a bet is placed in error as a result of human error or system malfunction, the bet will be voided and the Player’s bet will be cancelled.

    63.7.2.     APPENDIX 1: ADDITIONAL INFORMATION – BETTING

    In this Appendix, we set out further information additional information on how we operate, how Winnings will be calculated for Successful Bets, Successful Syndicate Bets (as defined below) and the terms that apply in relation to the same.

    A. DEFINITIONS

    For the purposes of this Appendix, the following terms will have the following meanings:

    "Combo Bet" – choosing one or more extra numbers in addition to the Main Numbers and where applicable to the Special Numbers. In a Combo Bet, every combination will be considered as a separate betting slip.

    "DoubleJackpot" – an additional option that a Player can select when placing a Bet on a Source Lottery which doubles Prize Group 1 (in Prize Class A) Winnings under a Successful Bet. Note that DoubleJackpot will not apply on Winnings under Prize Groups other than Prize Group 1.

    "Main Number(s)" – the numbers that you select as being the main numbers of your Bet which may be drawn in a Source Lottery.

    "Private Roll-Over" – The Private Roll-Over may be offered by us in our sole discretion from time to time if the Source Lottery Jackpot is won by a player who is not a Jackpot.com Player. In this event we may determine that the Jackpot amount remains the same for a number of additional draws in our sole discretion.

    "Prize Class" – the class within which a Prize Group will fall, depending on the rules of the Source Lottery, and which determines how the applicable Winnings are calculated, among which are Prize Class A, Prize Class B or Prize Class C.

    "Prize Group" – the group within which a Successful Bet will fall, depending on the number and allocation of Main Numbers and Special Numbers selected when placing such Successful Bet (in accordance with the rules of the applicable Source Lottery). Prize Groups will be denoted by numbers ranging from 1 to 13.

    "Source Lottery Jackpot" – the aggregate amount payable by the Source Lottery Operator to a person who participates in a Source Lottery in respect of all Source Lottery Prize Tickets in a Prize Group in Class A or Class B (as such are set in the Prizes Table below) with regards to the relevant draw of the Source Lottery, as announced by the Source Lottery Operator.

    "Source Lottery Operator" - the entity that organises and runs the Source Lottery.

    "Source Lottery Prize Ticket(S)" – any winning ticket in the Source Lottery.

    "Special Number(s)" – any number in addition to the Main Numbers which are drawn separately from the main draw, whether selected by a Player as additional number(s) (e.g. “Powerball Number”, “Lucky Star Number” etc.), or as bonus numbers that do not require a separate bet from the Main Numbers. Special Numbers are not applicable to all Source Lotteries.

    ""Successful Syndicate Bets" – are Winnings in respect of a Syndicate, calculated as set out below.

    "Winning Jackpot Bet" – a Successful Bet, exclusively for Winnings in Prize Group 1. If we offer a package of Jackpot Only Bets – the bets are placed for each Source Lottery outcome separately.

    B. HOW WE OPERATE

    We act as a bookmaker in respect of Bets that you place on the outcome of Source Lotteries. We always endeavour to pay out all Winnings in respect of Successful Bets and in order to do so, we use certain hedging measures and financial instruments. In particular, we may take out insurance policies from third-party insurance providers (each, an “Insurance Provider”) in order to cover certain pay outs to Players.

    In some cases, we may purchase actual tickets in the relevant Source Lottery on behalf of you. In the event that we do so, and you are due Winnings in respect of a Successful Bet, we may require your assistance in claiming the applicable Winnings from the Source Lottery, which may include you having to claim the Winnings directly from the Source Lottery Operator. If we require you to do so, we will reimburse you for any reasonable expenses incurred by you during the process and as approved by us in advance. If you are unwilling or unable to assist, we may not be able to claim the Winnings from the Source Lottery.

    In claiming Winnings directly from the Source Lottery Operator, and in case such Winnings incur any taxes, duties or levies, these are to be borne solely by you and under no circumstances will we have any obligation to pay to you any amount that the Source Lottery Operator may fail to pay you and/or to any third party in connection with the foregoing.

    C. OUR LIABILITY TO YOU

    As a result of the foregoing hedging techniques, whilst we will make every effort to pay out as per the prizes breakdown below ("Prizes Breakdown"), and depending on the technique used, we may be reliant on: (i) the Source Lottery Provider paying us the applicable Winnings; and (ii) the Insurance Provider paying out the insurance claim submitted by us pursuant to a Successful Bet. Amounts received pursuant to sub-sections (i) and (ii) above shall hereinafter collectively be referred to as, the "Funds".

    Provided we have used reasonable endeavours to obtain the Funds, you acknowledge and agree that we will only be liable to you for any Winnings in respect of Successful Bets to the extent that we have actually received the Funds from the applicable third party. We will pay your Winnings to you to the extent that, and as soon as we receive the corresponding Funds from the applicable third party. As a result, there may be instances where your receipt of Winnings in respect of a Successful Bet may be delayed and/or we may be unable to pay out in accordance with the Prizes Breakdown.

    D. CLASSIFICATION AND CALCULATION OF WINNINGS

    Following each draw of a Source Lottery by the Source Lottery Operator, we will calculate the Winnings for each Successful Bet made in respect of such Source Lottery (in accordance with the provisions set out below) in the original currency of the Source Lottery. It may take us a short period of time to do so, and to notify you of any Winnings.

    We endeavor to ensure that all Jackpot values for lotteries offered on the Website are correct, but we assume no responsibility for errors contained in such information. We estimate the value of future Jackpots using certain assumptions, such as the current or future Jackpot being won or rolled over and at times, we enable the placing of Bets on draws before the official Jackpot value is published (and clearly note this when it occurs). We are not liable for incorrect assumptions, calculations or forecasts in respect of Bets for draws that are made before the final Jackpot value is published.     Prize Groups, Prize Classes and Classification of Winnings

    The Prize Group in which a Successful Bet will fall into will depend on the number and combination of winning numbers matched by the Player in his/her bet with the draw of the Source Lottery. These are denoted by the numbers in the Prizes Breakdown above. When two numbers are referenced in the brackets, the first number represents the amount of the Main Numbers that need to be matched and the second number represent the amount of the Special Numbers that need to be matched in addition to the Main Numbers. Where only one (1) number is listed in brackets, no Special Numbers apply.

    For example, in the Prizes Breakdown table above, for the EuroMillions Source Lottery '2 (5+1 correct)' is listed in the Class B Prize column. This means that Prize Group 2 for this Source Lottery falls within the Class B Prize Class (and therefore Winnings will be calculated in accordance with the calculations set out below for Class B). The numbers in brackets mean that in order for a Successful Bet to fall within Prize Group 2, it must match 5 Main Numbers and 1 Special Number correctly.

    Calculation of Winnings

    Depending on which Prize Class a Prize Group falls within, a formula will be applied to calculate the applicable Winnings. The same formula is applied for Class A and Class B, however the calculation that applies to Class C differs.

    Below we set out further information in respect of each:

    Winnings for Prize Groups in Class A, A* or B

    The Winnings payable in respect of Successful Bet will depend on the number of Successful Bets in the applicable Prize Group and the applicable Jackpot in that Prize Group. Winnings for a Successful Bet in Prize Group 1 (in Prize Class A) will be calculated using the following formula:

    Winning for a Successful Bet = P / (m + n)

    and for Prize Groups in Class B:

    Winning for a Successful Bet = P / (m + n)

    Where:

    • "n" is the number of Source Lottery Prize Tickets within the Prize Group;
    • "m" is the number of Successful Bets within the Prize Group; and
    • For Class A: "P" is the Source Lottery Jackpot within the Prize Group.
      For Class A*: "P" is the lower of AUD 4,000,000 and (n+m) times AUD 1,000,000.
    • If the Source Lottery Winning Bet in Prize Group 1 (in Prize Class A) is with DoubleJackpot, the Winnings are doubled.

    Only One Successful Bet in Prize Group 1

    If there is only one Successful Bet in Prize Group 1 and no Source Lottery Prize Tickets have been announced, the Winnings payable in respect of such Successful Bet are:

    Winnings = Jackpot in that Prize Group 1.

    If the Successful Bet in Prize Group 1 is with DoubleJackpot, the Winnings are doubled.

    Example 1:

    There is only one Successful Bet in Prize Group 1 in respect of a Source Lottery Jackpot in Prize Group 1 of 50,000,000.00 EUR and no Source Lottery Prize Tickets have been announced. The Winnings payable in respect of that single Successful Bet amount to 50,000,000.00 EUR, in accordance with the following calculation:

    • The Source Lottery Jackpot for Prize Group 1 (in Prize Class A) is 50,000,000.00 EUR (P = 50,000,000.00 EUR).
    • There is one Successful Bet that falls within Prize Group 1 (i.e. m = 1) and no Source Lottery Winning Ticket is announced for Prize Group 1 by the Source Lottery Operator (i.e. n=0).
    • The Winnings payable with regards to the Successful Bet are 50,000,000.00 EUR (being 50,000,000.00 / (1 + 0)) or 100,000,000.00 EUR (being 100,000,000.00 / (1 + 0)) with DoubleJackpot.

    More than One Successful Bet in Prize Group 1

    If there is more than one Successful Bet in Prize Group 1 and no Source Lottery Prize Tickets have been announced, the Winnings payable in respect of Successful Bets in Prize Group 1 are divided equally between the aggregated number of Successful Bets applicable to such Source Lottery draw, as follows:

    Winnings = Jackpot in that Prize Group 1 / aggregated number of Successful Bets. If a Winning Bet in Prize Group 1 is with DoubleJackpot, the Winnings are doubled.

    Example 2:

    • The Source Lottery Jackpot for Prize Group 1 is 40,000,000.00 EUR (i.e. P = 40,000,000.00 EUR).
    • There are two Successful Bets that falls within Prize Group 1 (i.e. m = 2) and no Source Lottery Prize Tickets are confirmed for Prize Group 1 by the Source Lottery Operator (i.e. n=0).
    • The Winnings payable with regards to each Successful Bet are 20,000,000.00 EUR (being 40,000,000.00 / (2 + 0)).

    • More than One Successful Bet in Prize Group 1 and Source Lottery Prize Tickets Confirmed

      If there is more than one Successful Bet in Prize Group 1 and Source Lottery Prize Tickets have been announced, the Winnings payable in respect of Successful Bets in Prize Group 1 are divided equally between the aggregated number of Successful Bets applicable to such Source Lottery draw plus the number of Source Lottery Prize Tickets announced, as follows:

      Winnings = Jackpot in that Prize Group 1 / aggregated number of Successful Bets plus the number of Source Lottery Prize Tickets announced.

      If a Winning Bet in Prize Group 1 is with DoubleJackpot, the Winnings are doubled.

      Example 3:

      • The Source Lottery Jackpot for Prize Group 1 is 50,000,000.00 EUR (i.e. P = 50,000,000.00 EUR).
      • There are two Successful Bets that falls within Prize Group 1 (i.e. m = 2).
      • Two Source Lottery Prize Tickets are confirmed for Prize Group 1 by the Source Lottery Operator (i.e. n=2).
      • Winnings payable with regards to a Successful Bet are 12,500,000.00 EUR (being 50,000,000.00 / (2 + 2)).
      • If a Winning Bet in Prize Group 1 is with DoubleJackpot, the Winnings are doubled.
      • Winnings for Prize Groups in Class C

        If a Successful Bet for a Prize Group falls within Class C, the applicable Winnings will correspond with the prize payable by (and as reported by) the Source Lottery Operator for the corresponding Source Lottery Prize Ticket as if the Player had purchased that Source Lottery Prize Ticket.

        Should the Source Lottery Operator have the ability to either pay Winnings as a cash prize or a free play, we may determine, in our sole discretion, whether the Winnings shall be a cash prize or a free play.

        For example, if you placed a bet on the EuroMillions (not in the UK) and you matched 3 Main Numbers and 2 Special Numbers, such Successful Bet would fall within Prize Group 6 (in Prize Class C). The amount of Winnings due to you from us would correspond with the amount that you would have received from the Source Lottery Operator had you purchased the corresponding Source Lottery Winning Ticket, except for games based on the iRNG, which are paid out as published on the Website and are independent of the Winnings published by Source Lottery Operators.

        Winnings for Millionaire

        Contrary to the provisions above, Winnings in Millionaire are paid out as published on the Website. While the winning numbers for these games are taken from Swiss Loto Express, the number of Source Lottery Prize Tickets from Euromillions draw on the same day as the Millionaire draw is taken for the calculation of the Winnings.

        Syndicates

        Winnings for Successful Syndicate Bets are calculated by three steps, as follows:

        Step 1 – Calculation of Total Syndicate Winnings for the Syndicate in which the Player has bought shares:

        Total Syndicate Winnings = The sum of all Winnings for all Successful Bets forming part of the Syndicate in which the Player bought shares.

        Step 2 – Calculation of Syndicate Fraction:

        Syndicate Fraction = Number of Shares bought by the Player / Total of Shares advertised for the relevant Syndicate.

        Step 3 – Calculation of Winnings for the Successful Syndicate Bet:

        Winnings for this Successful Syndicate Bet = Total Syndicate Winnings for the Syndicate in which the Player has bought shares multiplied by the Syndicate Fraction.

        Example 1: A Successful Syndicate Bet with Total Syndicate Winnings of 50,000,000.00 EUR occurred. The Syndicate Fraction is 1 of 5. The Winnings for this Syndicate Winning Bet are 10,000,000.00 EUR.

        Example 2: A Successful Syndicate Bet with Total Syndicate Winnings of 40,000,000.00 EUR occurred. The Syndicate Fraction is 1 of 8. The Winnings for this Syndicate Winning Bet are 5,000,000.00 EUR.

        What happens if the Source Lottery Operator fails to announce any prize?

        If the Source Lottery Operator fails to announce any prize in the appropriate Prize Group (i.e. there is no Source Lottery Prize Ticket for the Prize Group), the Winnings payable in respect of each Successful Bet in that Prize Group shall be based on the proportion of the total prize pool fund allocated to that Prize Group by the Source Lottery Operator. If the Source Lottery Operator does not publish the total prize pool fund, then we will, in good faith, attempt to calculate the applicable prize (and hence your Winnings) from publicly available information and the calculus used by the Source Lottery Operator (in the last time it was published). Before your Winnings are paid to you, we can, at your request, provide you the calculation used by us, as once they are paid, you will not (in the absence of our error) be able to dispute the calculation of the sum.

        For example:

        • • A Source Lottery Operator does not publish a prize for Prize Group 2.
        • • The announced Jackpot (Prize Group 1) for this Source Lottery was EUR 8,000,000. The Source Lottery Operator allocates 80% of the prize fund to the Jackpot and 5% to Prize Group 2.
        • • If Prize Group 2 falls in Prize Class B and the number of Successful Bets in this Prize Group is 2, then Winnings are calculated as follows:

        Winnings = 8,000,000 x (0.05 / 0.8) / 2 = EUR 250,000

        • • If the Prize Group 2 falls in Prize Class C, then Winnings are calculated as follows:

        Winnings = 8,000,000 x (0.05 / 0.8) = EUR 500,000

        Pay outs by one Prize Group to another

        The terms detailed above are based on the assumption that there is no pay out of prizes by one Prize Group to another, resulting from there being either:

        • • no Source Lottery Prize Tickets in a Prize Group for a draw;
        • • no Source Lottery Prize Tickets in a Prize Group for a series of subsequent draws; or
        • • a cap on the available Jackpot. For example, if the Jackpot exceeds a certain amount, then the amount that this is exceeded by is distributed to other Prize Groups.

        Withholding for Prizes in SuperEnalotto

        For Prize Group 1, 2 and 3, we will deduct 12% of the Winnings before pay out to you. This withholding aims to place the Player in a similar economic position they would have been had they played the Source Lottery.


      MUSL PowerBall and MUSL Mega Millions and MUSL Lotto America

      The following additional terms apply solely in respect of the MUSL PowerBall, MUSL Mega Millions and MUSL Lotto America.

      We can choose to pay out any Winnings for Prize Group 1 with regards to MUSL Mega Millions, MUSL Powerball and MUSL Lotto America over a period of up to 30 years (the "MUSL Deferment Option Payment Plan"). Under the MUSL Deferment Option Payment Plan, we will make the first instalment as soon as practicable following the relevant draw, with the subsequent 29 instalments to be made at yearly intervals. The amount of those instalments is calculated so as to rise by a percentage set annually by MUSL until satisfaction of the full amount due.

      Should we decide instead to pay out the Winnings in a one-off payment (the "Single Payment Option"), in accordance with the rules of MUSL Mega Millions, MUSL Powerball and MUSL Lotto America, the total Winnings payable to you (after any applicable withholdings have been applied as set out below) may be reduced by 40% or such percentage as MUSL shall announce in respect of those particular Winnings if the latter is higher than 40%.

      For example, if you were due $30,000,000 (USD) (following any applicable withholdings have been applied as set out below) and we chose to pay you by the MUSL Deferment Option Payment Plan, you would receive $1,000,000 in year 1, and then $1,000,000 (plus the additional yearly uplift set by MUSL) each year thereafter for 29 years. If we chose to pay you by the Single Payment Option, you would receive $18,000,000 (USD) in one lump sum.

      The decision of whether to distribute Winnings under either the MUSL Deferment Option Payment Plan or the Single Payment Option is at our sole and absolute discretion.

      Withholding for Prizes in MUSL PowerBall, MUSL MegaMillions and MUSL Lotto America

      For Prize Group 1, 2 and 3 we will deduct 39.6% of the Winnings before pay out to you. This withholding aims to place the Player in a similar economic position they would have been had they played the Source Lottery.

      GluecksSpirale

      We can choose to pay out any Winnings for Prize Group 1 with regards to GluecksSpirale over a period of up to 20 years (the “GluecksSpirale Deferment Option Payment Plan”). Under the GluecksSpirale Deferment Option Payment Plan, we will make the first instalment as soon as practicable following the relevant draw, with the subsequent 239 instalments to be made at monthly intervals.

      Should we decide instead to pay out the Winnings in a one-off payment (the “Single Payment Option”), in accordance with the rules of GluecksSpirale, the total Winnings payable to you do not amount to the sum of all monthly payments, but are reduced by discount factor as published by the Source Lottery Operator.

      The decision of whether to distribute Winnings under either the GluecksSpirale Deferment Option Payment Plan or the Single Payment Option is at our sole and absolute discretion.
